Terms of Service

Effective date: October 13, 2025

These Terms of Service ("Terms") govern your access to boldoff-road.com and your use of Bold Off-Road’s repair, installation, and parts sales services. By requesting a quote, booking service, purchasing parts, or using our website, you agree to these Terms.

1. Who we are

Bold Off-Road, LLC provides powersports and off‑road services and parts. Address: 601 3rd St S, Coggon, IA 52218. Phone: (563) 277‑8830.

2. Services

We perform diagnostics, repairs, upgrades, and accessory installations for UTVs, ATVs, dirt bikes, trucks, SUVs, and Jeeps, and we sell parts and accessories subject to availability.

3. Quotes, orders, pricing, and taxes

• Quotes are estimates based on information you provide and are subject to verification upon inspection.

• Prices may vary due to parts availability, supplier changes, disposal or shop fees, and taxes.

• We may refuse or cancel an order for valid reasons, including safety concerns or parts unavailability.

4. Authorizations and approvals

You authorize us to operate, move, and test your vehicle and to perform the approved work. Additional repairs discovered during service will be quoted and require your approval before we proceed, except where immediate action is reasonably necessary to protect safety or prevent further damage.

5. Parts and special orders

• Special‑order parts may require non‑refundable deposits. Lead times are estimates and not guarantees.

• Installed or electrical parts and custom‑ordered items may be non‑returnable under supplier policies.

6. Payment terms

• Unless otherwise stated in writing, payment is due upon completion for service and at time of sale for parts.

• You authorize charges to your payment method for approved work, storage, shop fees, and applicable taxes.

• Past‑due balances may accrue late fees as permitted by law. You are responsible for reasonable collection costs and attorney fees.

7. Vehicle storage and lien

Vehicles left more than five (5) days after notice of completion may incur daily storage charges. We may assert a mechanic’s lien to secure payment for authorized services and parts in accordance with Iowa law.

8. Modifications and compliance

Off‑road and performance modifications can affect vehicle handling, emissions, noise, and legal compliance. You are responsible for ensuring your vehicle complies with applicable laws for on‑road or off‑road use. We make no representation that modifications are street‑legal.

9. Test drives and risk

You authorize reasonable test operation to confirm repairs. We are not responsible for failures unrelated to the approved work or due to pre‑existing conditions.

10. Warranties

Except for any express written warranty provided at the time of sale or service, the services and parts are provided "as is" and "as available." Supplier warranties, if any, pass through to you. Some jurisdictions limit disclaimer scope; statutory rights may apply.

11. Limitation of liability

To the fullest extent permitted by law, Bold Off-Road is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the website, services, or parts. Our aggregate liability will not exceed the amount you paid for the specific service or part giving rise to the claim during the three months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Bold Off-Road, its owners, employees, and contractors from claims, damages, and expenses arising out of your breach of these Terms, misuse of the services, or unlawful vehicle operation.

13. Website use and acceptable use

• Do not attempt to interfere with site security or use automated scraping without permission.

• Do not submit unlawful, infringing, or deceptive content.

• We may suspend access for misuse or to protect the site.

14. Intellectual property

Website content and logos are owned by Bold Off-Road or licensors and protected by law. You may not copy or create derivative works without permission.

15. Electronic communications and SMS

By providing contact information, you consent to receive service‑related emails or texts about scheduling, approvals, and pickup. Marketing messages will be sent only as permitted by law and can be opted out at any time. Standard message and data rates may apply.

16. Dispute resolution and governing law

These Terms are governed by the laws of the State of Iowa. Before filing suit, the parties will attempt to resolve disputes informally for at least 30 days after written notice. Either party may bring qualifying claims in small claims court. If any provision is unenforceable, the remainder will remain in effect.

17. Changes to the services or terms

We may update the website, policies, or pricing from time to time. Updated Terms will be posted with a new effective date.

18. Termination

We may refuse or discontinue services where necessary to protect safety, comply with law, or for nonpayment. You remain responsible for amounts incurred prior to termination.

19. Entire agreement and contact

These Terms, together with any invoice, work order, or written service authorization and our Privacy Policy, form the entire agreement. For questions, call (563) 277‑8830 or use the contact form at boldoff-road.com/contact.
